Application
By placing an online order the customer agrees to these terms and conditions.
Prices
The prices listed on the website are in euros, including VAT and excluding shipping costs. They are valid on the day they are offered on our website and on the day the order is placed. All prices are per piece, unless otherwise indicated. By Choux cannot be held liable for price indications that are obviously incorrect, e.g. as a result of obvious import, printing or conversion errors.
The shipping costs are calculated based on the rates of BPost. If you live in Belgium, you pay the standard shipping costs of 3.95 euros. For the Netherlands we charge 4.95 euros. Orders over 100 euros will be shipped for free (in Belgium and the Netherlands). For Germany, France and the US shipping fee is 6.95 euros. For other countries we charge 11.95 euros.
Order
After placing an order, you will receive a confirmation email containing the confirmation of your order and the total cost.
If a mistake has crept into the stock system, and the chosen item is no longer available, you will be notified within 2 working days.
Payment
By Choux works together with partner Mollie for a secure payment environment. This payment platform is integrated into the By Choux webshop. Payment can be made via credit card payment (Visa or Mastercard), via Bancontact/Mister Cash, and Apple Pay.
A payment by credit card (Visa or Mastercard) is free of charge for the customer and fast. The payment is registered immediately and we can then immediately ship the order.
It is also possible to pay by Bancontact or Mister Cash card. The sum is immediately withdrawn from your account and By Choux can immediately start preparing your package for shipment.
Shipping & returns
Delivery
By Choux tries to ensure the fastest possible delivery. In the section below (Delivery time) we try to give an indication of our delivery times. However, these timescales are indicative and are given purely as a guide. By Choux cannot be held responsible for delays incurred, beyond our control.
The Buyer shall provide By Choux with the delivery address. If this address is found to be incorrect, this is the responsibility of the Buyer and additional charges may apply.
When the order has left our premises correctly, but gets lost at the shipping partner (Bpost), contact us, so we can take approrpiate actions with our shipping partner.
Delivery time
For Belgium: as soon as we have received your payment, your package will be prepared for shipment. Within 1 to 2 working days after receiving your payment, we will send your package through BPost. The package will be placed in your mailbox by the letter carrier, normally within 24 hours after shipment. You do not need to be at home to receive it.
For the Netherlands: as soon as we have received your payment, your package will be prepared for shipment. Within 1 to 2 working days after receipt of your payment we will send your package, using Bpost. The parcel will be delivered to your home by BPost within 3 working days. If you are not present at the time of delivery, you will receive a written notification in your mailbox and you can collect your package yourself at the post office.
Rest of Europe: as soon as we have received your payment, your package is prepared for shipment. Within 1 to 2 working days after receipt of your payment we will send your package, with the help of Bpost. The package will be delivered to your home within 6 working days. If you are not present at the time of delivery, you will receive a written notification in your mailbox and you can pick up your package at the post office. If you wish, you can of course always enter your work address or the address of a neighbor or friend.
By Choux cannot be held responsible for delays incurred during shipment by Bpost. In accordance with the law "buying at a distance", the maximum delivery period is thirty days, unless agreed otherwise. If this delivery period is not feasible, By Choux must notify the Buyer in good time and the Buyer has the right to cancel the order, at no additional cost. Any amounts already paid will in that case be refunded within thirty days.
Return your purchase
As a consumer you have the right to notify us that you return the purchase, without payment of any penalty and without giving any reason, within 14 working days from the day following the delivery. After the day notifying us you have additionally 14 working days to send the goods back. If you wish to invoke this option, we recommend you to send an e-mail to contact@bychoux.com with this form filled in
and send the goods back at your own risk and expense to:

As soon as we receive the goods, in original and undamaged condition, the amount will be refunded immediately with the same payment method. However, we may withhold compensation from the refund in the event of and depending on the damage.
We will refund the original shipping costs if the entire order is returned.
Repair and warranty
You have a warranty of two years after receipt on the jewellery of By Choux. We advice you to contact us via e-mail and send a picture of the problem. So, we can decide to repair or send a new piece. For reperation the shipping cost will be provided by us. The warranty is not valid in case we can prove with evidence that the jewellery did not have the problem at the moment of purchase.

By ordering you declare to be over 18 years of age.
Ordering at By Choux requires you to provide us with your customer data. By Choux uses this information for the administration of your order, the management of orders, deliveries and invoices, the follow-up of payments and finally for marketing and advertising purposes, insofar as you have given your consent for the latter during the ordering process. Your data will not be passed on, rented or sold to third parties. You, as a Buyer, have the right to inspect and improve this data at any time.
